Human act or Personal act

“acts that proceed from insight and freewill.”

 Constitute of Human Act
   1. Intellectual constituent

The will can decide for something and seek only if it is known. Hence human act is voluntary ONLY if its different elements are sufficiently known. Man cannot will with out knowing what object he is concerned with, without being master and conscious of the act he is to perform without evaluating the action(good/evil)

    *evaluative knowledge is needed: involves and touches the heart

Example:
•If a woman receives a ring as a gift, not knowing that it is stolen, she is not guilty of any offence, but a victim of ignorance that excuses her from guilt

•If a man robs and strikes a person not knowing he is a priest, the robber is guilty of criminal injury but not personal sacrilege

   2.Volitive constituent

The quest for good(formal element of every desire) + free element(material element of desire) = act of man

The act should be: voluntary and free from internal and external compulsion

-performed without the intervention of the intellect and free will

  ex. All spontaneous biological and sensual processes (nutrition, breathing, sensual impressions); acts that performed by asleep, lunatics and drunken individual; all spontaneous reaction
